Uzbekistan has been a member of the Paris Convention for the Protection of Industrial Property and the Patent Cooperation Treaty (PCT) since December 25, 1991. Additionally, the country is a signatory to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for Patent Procedure and the Patent Law Treaty (PLT). Intellectual property protection in Uzbekistan has evolved and strengthened over time, with significant milestones such as the creation of the State Patent Office in 1992 and the introduction of intellectual property provisions in the Civil Code in 1996. Until 2019, the Intellectual Property Agency of the Republic of Uzbekistan was responsible for overseeing intellectual property protection. However, following Presidential Decree No. PD-4168 on February 2, 2019, the agency was transferred to the Ministry of Justice and reorganized as the Intellectual Property Agency within the Ministry of Justice.

DEADLINE TO FILE PATENT APPLICATION IN UZBEKISTAN

The deadline for entering the national phase of a PCT application in Uzbekistan is 31 months from the priority date.

LANGUAGE TO FILE PATENT APPLICATION IN UZBEKISTAN

An international application must be translated into either Uzbek or Russian. If the PCT application is filed in a language other than these, a translation of the claims and abstract into Uzbek or Russian must be submitted when entering the Uzbek national phase. The translation of the remaining application materials can be provided within two months after entering the national phase in Uzbekistan.

EXTENSION FOR FILING LATE PATENT APPLICATION IN UZBEKISTAN

An extension for filing a late patent application in Uzbekistan is permitted within 12 months after the original deadline, as long as the applicable official fee is paid and a valid reason for the delay is provided.

REQUIREMENTS FOR FILING PATENT APPLICATION IN UZBEKISTAN

Power of Attorney: A Power of Attorney, simply signed, should be submitted at the time of entering the PCT national phase in Uzbekistan if the applicant is an individual. If the applicant is a legal entity, a signed and stamped Power of Attorney should be provided to the Uzbek Patent Office upon national phase entry. Official legalization or notarization of the Power of Attorney is not necessary.

COST EXEMPTION AVAILABLITY FOR PATENT APPLICATION IN UZBEKISTAN

The examination fee is reduced if an international search or an international preliminary examination report has been established, as follows: the examination fee and the fee for each independent claim exceeding one.

FILING REQUEST FOR EXAMINATION PATENT APPLICATION IN UZBEKISTAN

A request for examination of a patent application in Uzbekistan must be filed within three years from the application's filing date.

PAYING RENEWAL FEE FOR PATENT APPLICATION IN UZBEKISTAN

The first post-grant renewals, starting from the 3rd year, must be paid within the specified term. All subsequent renewals are calculated from the international filing date and must be paid before the anniversary of that date.

PATENT TERM

The validity of patents in Uzbekistan lasts for 20 years from the international filing date. For inventions in the fields of pharmaceuticals or agrochemicals, it is possible to request an extension of the patent term for an additional 5 years, granted through the issuance of a Supplementary Protection Certificate (SPC).

The country is recognized as an overperformer within its income group, demonstrating exceptional innovation capabilities beyond what would typically be expected. As a lower-middle-income economy, Uzbekistan ranks 10th among the 38 economies in this category and stands 4th among the 10 economies in Central and Southern Asia. This performance underscores Uzbekistan’s ability to surpass innovation expectations relative to its income level. Furthermore, Uzbekistan has made notable progress this year, improving its position to 71st in innovation inputs, further affirming its growing role in the global innovation landscape.
