Seychelles has been a Contracting Party to the Paris Convention for the Protection of Industrial Property and the Patent Cooperation Treaty (PCT) since November 7, 2002. Additionally, Seychelles is a member of the African Regional Intellectual Property Organization (ARIPO). 

DEADLINE TO FILE PATENT APPLICATION IN SEYCHELLES

A national phase application for a PCT application in Seychelles must be filed within 31 months from the priority date.

LANGUAGE TO FILE PATENT APPLICATION IN SEYCHELLES

The application must be filed in English. If the original application is not in English, an English translation must be submitted at the time of filing of national phase application in Seychelles. 

EXTENSION FOR FILING LATE PATENT APPLICATION IN SEYCHELLES

In Seychelles, the deadline for filing a patent application cannot be extended once it has passed. 

REQUIREMENTS FOR FILING PATENT APPLICATION IN SEYCHELLES

Documents required to file national phase application in the said country are as follows:

 

  • Power of Attorney: A notarized power of attorney is required to be submitted in Seychelles within two months of the filing date. 

COST EXEMPTION AVAILABLITY FOR PATENT APPLICATION IN SEYCHELLES

There is no cost exemption available for patent application in Seychelles. 

FILING REQUEST FOR EXAMINATION PATENT APPLICATION IN SEYCHELLES

In Seychelles, a request for substantive examination is not a separate procedure, as the Seychelles Intellectual Property Office does not conduct substantive examinations. 

PAYING RENEWAL FEE FOR PATENT APPLICATION IN SEYCHELLES

In Seychelles, the annual renewal fees are payable from the first anniversary of the filing date. A grace period of six months is provided for the late payment of patent renewals. 

PATENT TERM

In Seychelles, a patent is valid for 20 years from the filing date of the application.
