The designated period for submitting a patent application in Saudi Arabia under the framework of the Patent Cooperation Treaty (PCT) is 30 months from the earliest date of priority.

In the following jurisdiction, the official language for filing patent application is Arabic. If the application is submitted in a language other than Arabic, it must be accompanied by an Arabic translation. In Saudi Arabia, a translation of the patent application must be provided within 60 days of the filing date. This ensures accuracy and regulatory compliance, which make a seamless and trouble-free progression through the patenting procedures.

There is no provision for late entry into the national phase in Saudi Arabia. The established legal framework does not allow for extensions, emphasizing the importance of adhering to prescribed timelines.

The essential documents required for filing a national phase application include:

• Priority Document: It is imperative that a certified copy of the Priority Document be expeditiously submitted within a stipulated period of 90 days subsequent to the entry into the PCT national phase in Saudi Arabia.
• Power of Attorney: It is mandated that the original notarized and apostilled Power of Attorney be promptly filed within a designated period of 90 days from the date of the national phase entry in Saudi Arabia.
• Assignment Deed: In the event that the PCT national phase application in Saudi Arabia is submitted by an entity other than the inventor, it is imperative to furnish an apostilled Assignment Deed between the applicant and the inventor within a prescribed period of 90 days from the national phase entry date.

The reduction in the filing fee is applicable when the application is submitted by individual applicants. This measure reflects a deliberate policy aimed at encouraging and facilitating individual inventors to actively participate in the filing process.

It is imperative to note that a substantive examination for the application must be formally requested, and the associated fees must be remitted within a stipulated period of three months. Adherence to this timeline is crucial to ensure the expeditious and orderly progression of the examination process for the application.

Patent Prosecution Highway Program under the PCT

A series of bilateral agreements have been formally established among patent offices, aiming to foster worksharing initiatives and empower patent applicants to solicit expedited processing during the national phase. Within the contours of these agreements, patent examiners are enabled to leverage work products from other participating offices. These valuable work products encompass:

• The written opinion provided by the International Searching Authority.
• The written opinion presented by the International Preliminary Examining Authority.
• The international preliminary examination report issued within the framework of the Patent Cooperation Treaty (PCT), subject to specific conditions.

It is imperative to note that renewal fees for patents are due at the commencement of each year, commencing from the year subsequent to the filing date. In the event of non-compliance with the stipulated payment timeframe, a supplementary grace period of three months is granted. However, during this additional window, the fee incurs a doubling effect.

If the renewal fee is not paid within the stipulated extended timeframe, the application or patent will be rendered ineffective. This consequential outcome will be duly publicized in the Gazette.

It is imperative to underscore that within the legal framework of Saudi Arabia, the 20-year term allocated for patents remains non-extendable. Notably, the Saudi Arabian Patent Law lacks any provisions pertaining to patent term extensions. Therefore, the stipulated 20-year duration stands as an unalterable timeframe.

As of the Global Innovation Index (GII) for the year 2022, Saudi Arabia holds a position of 51st among the 132 featured economies. Notably, within the high-income group category, Saudi Arabia secures the 41st rank among 48 economies. Furthermore, within the specific region of Northern Africa and Western Asia, Saudi Arabia stands at an impressive 5th position among the 19 economies assessed.
