Saint Kitts and Nevis has been a member of the Paris Convention for the Protection of Industrial Property since April 9, 1995. It also became a Contracting Party to the Patent Cooperation Treaty (PCT) on October 27, 2005. 

DEADLINE TO FILE PATENT APPLICATION IN SAINT KITTS AND NEVIS

The deadline to enter the national phase is 30 months from the priority date of the international application. 

LANGUAGE TO FILE PATENT APPLICATION IN SAINT KITTS AND NEVIS

In Saint Kitts and Nevis, patent applications must be submitted in English. Although English is the official language, any documents in a different language must be accompanied by a certified English translation. 

EXTENSION FOR FILING LATE PATENT APPLICATION IN SAINT KITTS AND NEVIS

In Saint Kitts and Nevis, extensions are not permitted for the late filing of patent applications.

REQUIREMENTS FOR FILING PATENT APPLICATION IN SAINT KITTS AND NEVIS

Documents required to file the national phase application in the said country are as follows:

 

  • Statement and Declaration: A duly notarized Statement and Declaration of Use is needed for filing a patent application in Saint Kitts and Nevis. 

  • Power of Attorney: A duly notarized power of attorney should be submitted at the patent office. 

COST EXEMPTION AVAILABLITY FOR PATENT APPLICATION IN SAINT KITTS AND NEVIS

There is no cost exemption available for patent application in Saint Kitts and Nevis. 

FILING REQUEST FOR EXAMINATION PATENT APPLICATION IN SAINT KITTS AND NEVIS

In Saint Kitts and Nevis, the examination of a patent application is integrated into the standard procedure and does not require a separate request. 

PAYING RENEWAL FEE FOR PATENT APPLICATION IN SAINT KITTS AND NEVIS

Annual fees must be paid to the Office each year, starting one year after the filing date. A grace period of six months is allowed for the late payment of the annual fee, provided the prescribed surcharge is paid.

PATENT TERM

In Saint Kitts and Nevis, a granted patent remains valid for 20 years from the filing date of the application.
