Since January 01, 2004, Namibia has been a Contracting Party to both the Paris Convention for the Protection of Industrial Property and the Patent Cooperation Treaty (PCT). Additionally, Namibia is a member of the African Regional Intellectual Property Organization (ARIPO). Namibian intellectual property law is undergoing changes with the implementation of the Industrial Property Act, 1 of 2012, which took effect on 01 August 2018. The six-year delay in its enforcement was due to the authorities' failure to publish the necessary supporting regulations, forms, and fees. This issue was resolved with the publication of the Industrial Property Regulations in the Namibian Government Gazette on 01 June 2018.

DEADLINE TO FILE PATENT APPLICATION IN NAMIBIA

A national phase application in Namibia must be filed within 31 months from the priority date following a PCT application.

LANGUAGE TO FILE PATENT APPLICATION IN NAMIBIA

A translation of the international application into English is required if it was not filed in English, and the English translation must be submitted at the time of filing.

 

EXTENSION FOR FILING LATE PATENT APPLICATION IN NAMIBIA

In Namibia, extensions for the late filing of patent applications are not permitted.

REQUIREMENTS FOR FILING PATENT APPLICATION IN NAMIBIA

  • Power of Attorney: A Power of Attorney, signed simply, must be submitted within 2 months from the filing date.
  • Deed of Assignment: The Deed of Assignment must be filed within 2 months from the filing date.

There is no cost exemption available for patent application in Namibia.

FILING REQUEST FOR EXAMINATION PATENT APPLICATION IN NAMIBIA

A request for examination of a patent application in Namibia must be filed within 36 months from the priority date (or filing date, whichever is earlier), along with the required fees.

PAYING RENEWAL FEE FOR PATENT APPLICATION IN NAMIBIA

In Namibia, renewal fees are due annually, starting from the third year following the filing date of the patent application.

 

PATENT TERM

In Namibia, patents are valid for 20 years from the filing date of the application.
