Kyrgyzstan has been a committed Contracting Party to the prestigious Paris Convention for the Protection of Industrial Property and the Patent Cooperation Treaty (PCT) since December 25, 1991, firmly establishing itself on the global intellectual property stage. In addition, Kyrgyzstan is an active participant in the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for Patent Procedures, as well as the Patent Law Treaty (PLT), demonstrating its dedication to advancing international patent standards. Furthermore, as a proud member of the Eurasian Patent Organization (EAPO), Kyrgyzstan continues to play a significant and influential role in shaping the future of patent law across the Eurasian region.

The authorized state body of the Kyrgyz Republic in intellectual property is responsible for carrying out the country’s policies on protecting inventions, utility models, and industrial designs. It accepts applications for these protections, examines them, registers them, grants patents, publishes official information, and performs other tasks as outlined by the Kyrgyz government.

The deadline for entering the Kyrgyz national phase of a PCT application is an extensive 31 months from the priority date, providing applicants with a substantial period to complete the necessary procedures and filings.

The official languages for a Kyrgyz PCT application are Kyrgyz and Russian. While a Russian translation is acceptable for most parts of the application, it is essential that the claims are translated into Kyrgyz. Furthermore, if the PCT application is filed in any language other than the official languages, the complete translation into one of Kyrgyzstan's official languages must be submitted within an impressive three-month period from the date of entering the national phase.

The 31-month deadline for entering the national phase can be extended by 30 days, provided the applicant pays the required late entry fee.

The necessary documents for filing a national phase application in Kyrgyzstan include:

Power of Attorney: A Power of Attorney simply signed and stamped by the applicant(s) is required. Legalization and notarization are not required. The executed Power of Attorney should be provided to the Kyrgyz Patent Office within 2 months from the application filing date.

In Kyrgyzstan, fees are discounted by 50% if the international application is filed by a natural Person.

The substantive examination begins once a notification of a positive result from the formal examination is issued. The applicant must submit a request and pay the official fee for the substantive examination within 30 months from the filing date of the international application.

The first post-grant renewal fee, starting from the 3rd year, must be paid within this period. Subsequent renewals are calculated from the filing date and must be paid before the start of each following year.

A patent for an invention is valid for twenty years from the date the application is submitted to Kyrgyz patent. Upon the owner's request, Kyrgyz patent may extend the validity of a patent related to pharmaceuticals for a period of up to five years.

Kyrgyzstan is ranked 18th among the 38 economies in the lower-middle-income group, showcasing a strong position within this category. In Central and Southern Asia, the country holds an impressive 7th place out of the 10 economies, further emphasizing its regional standing. This year, Kyrgyzstan has achieved a notable 86th rank in innovation inputs, marking an improvement over the previous year and highlighting its growing commitment to fostering innovation and economic development.
