Jamaica has transitioned from a historically outdated patent regime to a contemporary legal framework that aligns with global intellectual property standards. The previous legislation, the Patent Act of 1857, was replaced by the Patents and Designs Act of 2020, which came into effect in 2022. This reform harmonizes Jamaica’s patent laws with key international treaties, including the WTO TRIPS Agreement, the Paris Convention, the Patent Cooperation Treaty (PCT), and the Hague Agreement, following the country’s accession to these agreements. The updated system is designed to strengthen intellectual property protection, support compliance with international norms, and foster innovation and economic advancement.

In Jamaica, the national phase of an international application must be initiated within 30 months from the earliest priority date.

If the international application is submitted in a language other than English, a certified English translation is required. In Jamaica, this translation must be filed within one month from the date the application is submitted.

In Jamaica, the law does not provide for an extension or grace period for the late filing of a patent application.

Power of Attorney: A power of attorney is required in cases where the application is submitted by an authorized representative.

There is no cost exemption for patent application in Jamaica.

A formal request for examination, accompanied by the necessary supporting documents, must be submitted to the Jamaica Intellectual Property Office (JIPO) to initiate the examination of a patent application. In Jamaica, the timeline for filing this request is deferred, as there is no fixed statutory deadline for submission.

In Jamaica, the continued validity of a patent is contingent upon the timely payment of renewal fees, also known as annuities, which must be made within 90 days of each anniversary of the patent’s filing date.

In Jamaica, the term of patent protection is 20 years from the filing date of the application.

In the 2024 Global Innovation Index (GII), Jamaica is ranked 79th out of 133 economies, reflecting a slight decline from the previous year. Within the upper-middle-income group, Jamaica holds the 23rd position among 34 economies. In the Latin America and Caribbean region, it ranks 10th among 20 economies. The country has improved its standing in innovation outputs, now ranking 65th, up from last year.

In 2023, the country’s GDP reached around $19.42 billion USD—a 13.6% rise from the previous year—with a per capita GDP of $6,874 and a growth rate of 2.20%. Economic forecasts suggest continued growth, with GDP expected to climb to $20.59 billion in 2024 and $21.59 billion by 2025, driven largely by tourism, bauxite mining, agriculture, and remittances.
