Georgia has been a Contracting Party to both the Paris Convention for the Protection of Industrial Property and the Patent Cooperation Treaty (PCT) since December 25, 1991. Additionally, it is a signatory to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for Patent Procedures. Following a validation agreement with the European Patent Organization, European Patents can now be validated in Georgia starting from January 01, 2024. The national law stipulates that the disclosure of an invention within one year prior to the application or priority filing date does not impact the novelty requirement in certain cases, such as when the disclosure is attributable to the inventor or the inventor's assignee.

DEADLINE TO FILE PATENT APPLICATION IN GEORGIA

The deadline for entering the national phase of the PCT in Georgia is 31 months from the priority date.

LANGUAGE TO FILE PATENT APPLICATION IN GEORGIA

The official language is Georgian. The Georgian PCT national phase can be initiated in any foreign language, provided that a Georgian translation is submitted within two months.

EXTENSION FOR FILING LATE PATENT APPLICATION IN GEORGIA

The restoration of this term may be requested either within 2 months following the resolution of the circumstances that led to the violation, or within 12 months after the expiration of the 31-month period, whichever occurs earlier.

  • Power of Attorney: The Power of Attorney must be submitted at the time of filing or within two months from the filing date. Official legalization or notarization is not required.

FILING REQUEST FOR EXAMINATION PATENT APPLICATION IN GEORGIA

A request for substantive examination must be made within two months of receiving the notification of a positive formal examination decision.

PAYING RENEWAL FEE FOR PATENT APPLICATION IN GEORGIA

The first renewal fees, covering the period from the 3rd year up to the year in which the patent is granted, must be paid together with the official grant fee. Subsequent annual renewal fees are calculated from the original filing date and must be paid before the start of each new patent year to maintain the patent in force.

PATENT TERM

The validity of a patent in Georgia is 20 years from the filing date. For pharmaceutical patents and agrochemical patents, an extension of up to 5 additional years may be requested. If the patent is extended, a Supplementary Protection Certificate (SPC) will be issued.
