Ecuador became a Contracting Party to the Paris Convention for the Protection of Industrial Property on June 22, 1999, and joined the Patent Cooperation Treaty (PCT) on May 07, 2001. Additionally, Ecuador is a member of the Andean Community of Intellectual Property (CAN), the regional intellectual property information platform LATIPAT, and the Cooperation System on Operational and Industrial Property Information (PROSUR). 

DEADLINE TO FILE PATENT APPLICATION IN ECUADOR

In Ecuador, the deadline to enter the PCT national phase is 31 months from the priority date. 

LANGUAGE TO FILE PATENT APPLICATION IN ECUADOR

A patent application must be filed with the Ecuadorian Patent Office in Spanish; submissions in other languages are not accepted, and late filing of a Spanish translation is not permitted. 

EXTENSION FOR FILING LATE PATENT APPLICATION IN ECUADOR

The timeframe to enter the national phase of 31 months cannot be extended. 

REQUIREMENTS FOR FILING PATENT APPLICATION IN ECUADOR

Documents required to file a national phase application in the said countries are as follows:

  • Power of Attorney: The original Power of Attorney, duly signed, notarized, and either legalized up to the Ecuadorian Consulate or apostilled. It may be submitted after a request from the Ecuadorian Patent Office, with a deadline of two months from the date of notification regarding the missing document.  

  • Assignment Deed: When the applicant is not the inventor and the statement of rights was not made at the WIPO International Bureau, an Assignment deed in Spanish must be filed with the Ecuadorian Patent Office. The deed, signed by both parties, notarized, and legalized or apostilled, can be submitted after the Patent Office requests it. The deadline for submission is two months from the notification of the missing document. 

COST EXEMPTION AVAILABLITY FOR PATENT APPLICATION IN ECUADOR

There is no cost exemption available for patent application in Ecuador. 

FILING REQUEST FOR EXAMINATION PATENT APPLICATION IN ECUADOR

Patent applications are subject to both formal and substantive examinations. The Request for examination fee has to be paid within 6 months from the publication date. 

PAYING RENEWAL FEE FOR PATENT APPLICATION IN ECUADOR

Renewal fees are required annually, starting from the international filing date, and must be paid for pending applications by the last day of the month in which the anniversary of the international filing date falls. Late payment is allowed within a six-month grace period, subject to the payment of an additional surcharge. 

PATENT TERM

In Ecuador, the patent term for inventions lasts 20 years from the application’s filing date. 

INNOVATION INDEX

In the 2024 Global Innovation Index (GII), Ecuador achieved a score of 19.3, ranking 105th out of 133 economies worldwide. This marks a slight improvement from its 107th position the previous year. Ecuador performed best in the categories of Infrastructure (80th), Business Sophistication (94th), Knowledge and Technology Outputs (96th), and Creative Outputs (98th). 

KEY FACTORS

Ecuador's economy contracted by 2.5 percent in 2024 due to severe energy shortages, high violence levels, and political instability, which weakened private investment and industrial activity. Despite these challenges, fiscal reforms helped reduce the deficit from 3.5 to 1.4 percent of GDP, supported by increased tax revenue and a US$4 billion IMF arrangement, including a US$1.5 billion disbursement. Export growth in agriculture and fisheries signaled potential for innovation-driven sectors, though structural barriers such as rigid labor laws, low productivity, and trade restrictions continue to hinder economic dynamism and intellectual property development.
