In India, a design patent is the legal protection granted to the creator of a new and original design for his work. This is the reward for the creator's efforts. The goal is to emonstrate that others will not readily imitate the creator's hard work.

The registered proprietor gains the exclusive right to apply a design to an article in the class in which the design is registered.

The most important requirement for registering a design is that it be new or original. Furthermore, the work had not previously been published or used in any country prior to the date of registration application.

The design may refer to shape, configuration, pattern, or ornamentation features applied to or applicable to an article.

Registering the design grants the creator rights for ten years, which can be extended for an additional five years.

An application for design registration can be made by filling out the appropriate form and paying the prescribed fee, as well as submitting four sets of design representations.

The CGPDTM E-filing portal can also be used to file an online design application. When a Design registration application is complete, it is accepted and registered, and a certificate of registration is issued to the applicant.
