MEANING OF ACADEMIC RESEARCH

Academic research is "a systematic investigation of a situation or problem with the objective of uncovering facts and/or ideas that would help deal with the situation or solve the problem," according to the definition of academic research. The objectives and questions of other researchers are at the focus of this academic or intellectual investigation. It looks for answers through rigorous, scientific, and structured processes. Academic research is conducted using existing theories as a framework to either confirm or refute this claim.

In our daily lives, the word "research" is employed in so many different contexts—from our pursuit of customer information to the creation of PhD-level research to problem-solving at work. Research is a methodical process of data collecting, analysis, and interpretation that helps us understand a subject that we are interested in or enthusiastic about. It is a drawn-out, specifically focused, thorough, gathered, and illuminating process, and you want facts to be sent from one place to another—not it's just about accumulating information.

A bundle of legal rights known collectively as "copyright" belong to the individual who originally authored an original work of authorship, such as a book, song, film, or piece of software. The person who developed the original work, or the owner of the copyright, has a right over that work. By prohibiting others from copying or replicating it, he can either let others access to it or keep full control.

Section 14 of the Copyright Act of 1957 defines copyright as the exclusive right to perform or authorize the performance of any of the following acts with respect to any substantial part of a work, namely:

 

1. Any format is acceptable for copying and storing the work.

2. Make the material accessible to the public in copies.

3. Execute the Task in Public

4. Do any kind of cinematic production in homage to the work

5. Do the translation

6. Create a modification of the piece

 

COPYRIGHT ISSUES IN EDUCATION

Copyright issues in education come often which can be studied in two respects –

Public domain- The term "public domain" refers to the state of belonging to or being available to the public as complete, especially when there are no copyright restrictions or other legal restraints. All artistic creations to which no Intellectual Property Rights apply are included in the public domain. Such rights could be incorrect, out of date, forfeited, or explicitly waived. Public domain works are creative creations that are not covered by copyright. These contain works that have endured for a sufficient amount of time. Additionally, it includes government-produced works that are not protected by copyright. Even if anybody may use or even sell a work that is in the public domain, the original creator must still be given credit. The public domain does not eliminate the original creator’s rights. Attributions must always be given, but one can alter the original work significantly.  

 

License and Copyright- When someone creates a work, he is the exclusive owner of the copyright, which gives us as the creator the exclusive right to possess that work. He determines who else may use the work and how. In order to use a work that is protected by copyright, one must obtain a license from the appropriate authority. Copyright and license assignments may include a number of restrictions and requirements. Restrictions may include restrictions on the manner in which the work may be used, the amount of time for which a license is valid, and payment obligations. It is always a good idea to put the specifics of a license in writing, whether you are giving or obtaining one. Also, it is a good idea to date and has both the licensor and licensee sign the written record of the license.

OWNERSHIP OF COPYRIGHT IN INDIA

According to Section 17 of the Copyright Act of 1957, the owner or first author of every other work—aside from private research work—shall be the person for or under whom the work is performed; in other words, in relationships between employers and employees, the employer shall be the owner of the work. With regard to government job, the same is true. The author, not the employer, will be the owner of their work in the event of a conflicting contract.

CONCLUSION

Ownership of scholarly research produced in and for educational institutions is projected to provide new challenges in light of the surge in technology improvements, especially in the academic field. When resolving copyright concerns involving academic research, a fundamental knowledge of legal ideas linked to copyright laws is required. Therefore, it can be concluded that academic researchers, scholars, authors, and examiners must exercise caution when taking on creative projects.
